Terms of Shipments - Non-Negotiable



Section 1A - What we need To Have to Book Your Space(s).

* Current HEALTH CERTIFICATE ~ Generally valid for 30 days

* A COGGINS TEST for Equine Infectious Anemia (EIA)~ Any previous test performed is good for 6-12 months in most states. (Be sure to check with your local and state laws to be 100% sure)

* List of any immunizations and/or medications ~ Please let us know if we need to provide your horses with any special attention to help them remain safe and comfortable.

** BRAND INSPECTION and certification ~ Several of our Western and Midwestern states require a brand inspection be done. This assures the horse owner and buyer that the horse's brand is legally transferring ownership. This process can be time consuming and is ONLY necessary if the state of origin requires this. Please allow enough time, as the laws are very strict in some states. Arizona still allows a horse thief to be HUNG !! The states requiring such inspections are; Arizona Nebraska Utah Colorado Nevada Washington Idaho New Mexico Wyoming Montana Oregon

*HORSE READINESS ~ Please be sure that you horse is ready to go when we show up at the barn, stable or ranch. Any Hay, Leg wraps, Blankets etc. should be on or ready to go at the time of arrival. Studs booked for shipment should have shoes removed before shipment in order to enter the van or trailer (No exceptions). We try to provide time frames for arrivals and pickups as accurately as possible. Phone calls are made to notify our arrival as well. Time spent on the trailer is very important for your horses and others. We appreciate your cooperation with this matter. An attendant, horse owner or agent must be present to load any and all horses, donkeys, llamas or alpacas for shipment. At no time will Sierra Company pick up or deliver shipments without proper personnel available by the direct parties listed on authorization paperwork. In the event personnel are not available, listed parties will be contacted by phone and a charge will be accessed for wait time entailed. If in the event the contracting parties cannot be present, all shipments listed will be cancelled with fees attached as listed in section 1A-1

Section 1A-1 - If You Need To Cancel Your Trip - We understand that at times you may need to cancel a trip due to illness or emergency. Any cancellations will result in a 10% deposit fee as filing fee. When an order is placed by Shipper for transportation service, and, due to no fault of Carrier, the cancellation of such request of service is made within 72 hours, a 20% cancellation fee shall apply. Cancellations less than 24 hours of departure will result in an 50% fee. When an order is placed by Shipper for transportation service, and, due to no fault of Carrier, the cancellation of such request of service is not made by Shipper prior to Carrier’s dispatch of vehicle in performance therewith, a charge of $1.00 per mile will be assessed and computed from the point of dispatch to the point of pickup and return to dispatch. (Any and All refunds shall be sent within a 30-day timeframe)

Section 1A-2 - Hard Loading Customers or Wait Time - Time is extremely important in order to provide accurate travel schedules and minimal hours on the trailer for other horses. We allow one half hour for any loader, waiting on paperwork, calling due to poor directions etc. After your 30-minute grace period, a fee will be added plus $35.00 per half hour. Please inform us if you will be running late to meet us for the departure schedule. We understand life is busy and full, and we want to make all our traveling friends as comfortable as we can. In the event a horse will not load safely within a 30 minute timeframe, diver on duty will notify contracting party or shipper thereof.

Section 1A-3 - If access to your barn, Farm or Destination is not an accessible, it is the horse owner's responsibility to bring the horse(s) to the road for loading and or unloading. Our rig is approximately 65-70 feet and we do not want to get your horse(s) stuck in the yard.

Section 1A-4 - Shipping agreement or destination changes - Any and all changes need to be notified emmediately. Any trailer damages from the horse(s) or property at pick up or delivery will be estimated on site and charged accordingly.

Section 1A-5 - Layover and Groom Request - Any layover request shall be at the rate of $15.00 per horse per night requested.

Section 2A

Section 2A-1 - Sierra Equine Transport Company agrees to act in a husbandry like manner to ensure all horses and riders are traveling safely.

Section 2A-2 - I hereby understand and agree that the liability of my horse(s) in discussion is Seirra Companies responsibility while on the van or trailer ONLY. Once the delivery of any and all goods has been made and a delivery signature is furnished, Sierra Equine Transport shall be fully released from any and all liabilities of the horse(s), animal(s) or goods. All tack and items for shipment not listed on authorization and or shipping paperwork will not be the responsibility of Sierra Company if not delivered or unloaded at the destination needed. All shipments via mail postage, UPS or FedEx, will be the horse owner’s responsibilities.

Section 2A-3 - The carrier’s basic rates per animal only apply only when the shipment is released to a value not exceeding $500 per animal. Shipper/Owner is encouraged to obtain it’s own insurance for any amount greater than the $500 declared value, it being acknowledged and understood by all parties hereto animals transported may have an actual value in excess of the declared value. Mortality insurance will be paid only in the event the Carrier is found fully negligent of improper husbandry like acts and care while in custody and or transit. Shipper takes full responsibilty for health and conditions of all horses, donkeys, Llamas and or alpacas before during and after transit. Sierra Company is not responsible for the acts occurring during transit of biting, kicking, goring or smothering, nor the loss or damage arising from the condition of the animal(s) themselves, or which results from their nature or propensities, which risks are assumed by Shipper.

Section 2A-4 - In the event that any of the horse(s) booked shall require a tranquilizer for any given reason, the owner shall fully release Sierra company from all liabilities. Furthermore Sierra Company will revoke all insurance coverage for mortality once a tranquilizer is administered. Administration of any type of tranquilizer will not be given by a member of or employee of Sierra Equine Transport Company.

Section 2A-5 - By signing the following you the customer fully understand the aforementioned amendment and agree that they can not hold Wayne Ukens, Sierra Equine Transport and or any employees liable in any way. Furthermore, any and all owners and paying parties fully agree not to take any legal action by suite filings of any such kind upon Sierra Company for any reasons mentioned, discussed or covered in the aforementioned agreement and/or contract.

Section 2A-6 - Sierra Equine Transport can at any time delay trips for safety related reasons as well as load commitments falling below 65% capacity prior to departure. Any and all delays will be notified immediately as to rescheduled shipping dates and approximate timeframes.

Section3A - Horse owner agrees to the following.

Section 3A-1 - To pay the agreed upon amounts a written in the terms of the shipping agreement (All extra fees shall be calculated and administered upon delivery). If at any time the horse(s), animal(s) or goods in discussion are refused for payment as agreed, Sierra Company shall retain full ownership as collateral until all fees and reshipment cost are paid in full. Any changes made to alter the shipping agreement terms will result in a direct cancellation of shipment.

Section 3A-2 – At any time monies paid by contracting parties are found to be – returned unpayable, insufficient, cancelled payments of checks, charge back claims against Sierra Company, Sierra will withhold all rights to recover fees as follows.

Section 3A-2.1 - Collection of fees owed for services rendered – A $65.00 fee will be attached to returned checks, plus any fees encured by Sierra Company due to failure to produce monies as deemed as faulty payments for services rendered.

Section3A-2.2 – Collections for stop payments on checks or claims filed for credit card payments – All fees and fines for losses to Sierra Company will be collected in accordance of state and federal laws and in the state of Oklahoma. Sierra Company withholds the right to collect on any fraudulent payments and claims as deems most suitable for the company and business. Practices will and can include the repossession of delivered properties of animal(s), pets, horse(s), Llamas, Donkey(s) and Paraphernalia in shipments contracted until all fees are settled or animal(s), Horse(s), Llamas, Donkey(s) and or Paraphernalia are sold to recover losses to company after a 45 day period. Charges will include Cost to Carrier at $1.80 per mile and board / Layover at $25.00 per day plus 18% interest of total due for credit received. Any and all charges encored to Carrier for shipment, board / layover and or lawyer fees shall be included without exemptions.
